Terms & Conditions


1. INTERPRETATION

In the Terms and Conditions the following definitions apply:

1.1  Member: the person purchasing a membership from the Company.

1.2  Company: Raw Strength Gym Ltd Unit 1 Trinity Court Warrington WA3 6QT.

1.3  Membership: the supply of an initial 6 month membership and/or any renewal membership.

1.4  Subscription: the monthly recurring fees payable or fees paid in advance.


2. MEMBERSHIP

2.1 Subject to condition 2.2 when a person has completed the terms and conditions, they become a Member.

2.2 Acceptance of a person as a Member is at the absolute discretion of the Company.

2.3 The Company reserves the right to expel, suspend for a specific period or refuse to renew the Membership of any Member whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Company, or which amounts to a breach of the Terms and Conditions, or where such expulsion is otherwise in the interests of the other Members of the Company.  Any Members so expelled will forthwith cease to be a Member of the Company and will not be entitled any refund for any period during which the membership is suspended.


3. FEES AND PAYMENT

3.1 Details of Membership fees are available directly from the Company.

3.2 Monthly fees are a recurring charge and payment is taken automatically on the 1st of every month.

3.3 Membership fees must be paid in accordance with the Terms and Conditions irrespective of whether the Member uses the facilities.  No refund is given for non-attendance.

3.4 Any Member, who is paying on a recurring monthly charge, will forfeit their membership and the right to use the facilities if they fall behind in payment for more than 10 working days.

3.5 Defaulted payments will be passed on to our legal department if an account remains overdue for more than 1 month from the date of the defaulted payment.

3.6 Failure to respond to communication regarding defaulted payments will result in legal action.


4. REFUNDS AND CANCELLATIONS

4.1 Memberships cannot be suspended or terminated during the initial 6 months term.

4.2 After the initial 5 months the Member can cancel the Membership by giving one full month’s notice in writing.

4.3 Written notice must be sent to rawstrengthgym@gmail.com. Any other means of communication to give notice is not accepted.

4.4 If notice is not given, the membership will continue, and fees will be required to be paid until such times as the member wishes to terminate their membership with one month’s notice

4.5 Where notice to cancel the Membership is received outside of condition 3.1, the Membership will be terminated one month from the next payment date. The next payment will still be charged, and no fees paid in that time will be refunded.

4.6 After the initial 6 months term has expired, contracts can be suspended for a maximum of 60 days if serious injury, illness (doctor's note must be provided) redundancy from employment or long term travel (2 months or more) occur.

4.7 Members who cancel and reinstate a Membership within a 3 month period, will be subject to a £20 admin fee.

4.8 Where a Members credit or debit card used to pay the recurring fees expires, new details must be supplied promptly to avoid membership interruption and further charges.


5. GROUP PROGRAM CANCELLATIONS

5.1 Members must give a minimum of 1 hours’ notice for cancellation of classes.

5.2 Where less than 1 hours’ notice is given, or the Member does not attend a class, the class will be forfeited and deducted from the monthly allowance.

5.3 In the case of a Group Program member not giving 1 hours’ notice, the class will be charged at the full rate and we reserve the right to deduct payment from the card held on file in the member’s name.


6. GENERAL

6.1 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the affairs of the Company and the conduct of Members.  Any such changes will be notified to Members and, until revoked are and will be binding for Members.

6.2 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the courts of England and Wales.
